Arbitration
Judge Fitzpatrick has thousands of hours of experience as an Arbitrator and presiding in a courtroom as a Judge. He has written hundreds of appellate opinions. Judge Fitzpatrick brings that expertise and those skills to the arbitration process to resolve complex disputes fairly, efficiently, and thoroughly. Judge Fitzpatrick is known for in-depth preparation which allows for cost-effective resolution of factual and legal issues. He thoughtfully considers the positions of the parties in order to reach a concise, reasoned, and accessible arbitration decision.
Mediation
Judge Fitzpatrick has successfully mediated dozens of settlements in complex, large-dollar disputes. His approach to mediation is as a consensus-builder through patient methods with judicial insights contoured to the specific needs of each dispute. Judge Fitzpatrick listens carefully to the parties and their counsel. He then assists the parties to open their perspectives toward a practical and solid settlement that avoids the risks and uncertainties inherent in litigation.
Special Master (Referee)
Judge Fitzpatrick serves as a court-appointed Special Master (Referee) to assist the court and parties in fact-finding on complex issues. In addition, he is available to assist the court and parties in the resolution of discovery disputes. Judge Fitzpatrick has practical judicial experience in a wide-range of discovery issues, including production of electronically-stored information, disclosure of privileged or confidential communications, and spoliation of evidence. He offers equitable resolutions with creative and cost-conscious methods.
Rates
Judge Fitzpatrick’s time is currently invoiced at the rate of $360/hour for all services. There is no charge for travel time in Wisconsin or to the Chicago area. Mileage is invoiced at the current IRS rate.
